Preamble
This Agreement is a legal agreement entered into between you (the "User" or "you") and 慢漫科技(广州)有限公司 (Faroam Co., Ltd.) (the "Company", "we", or "Manman Technology"; registered address: Room J202, 4th Floor, No. 11 Tangdong East Road, Tianhe District, Guangzhou) concerning your use of the Manman App (English name Faroam, Android package name com.faroam.app, hereinafter the "App") and related services.
Please read all the terms of this Agreement carefully before registering an account or using the App. If you click the "Agree" button, complete registration, or use the App in any manner, you are deemed to have fully read, understood, and accepted all the terms of this Agreement. If you do not agree to this Agreement, please do not use the App.
This Agreement is formulated in accordance with the 《中华人民共和国民法典》 (Civil Code of the People's Republic of China), the 《中华人民共和国网络安全法》 (Cybersecurity Law of the People's Republic of China), the 《互联网信息服务管理办法》 (Measures for the Administration of Internet Information Services), the 《移动互联网应用程序信息服务管理规定》 (Provisions on the Administration of Information Services of Mobile Internet Applications), and other applicable laws and regulations.
Chapter 1 Service Content
1.1 Introduction to the Faroam Platform
Manman (Faroam) is a travel community App designed for independent travelers, backpackers, and in-depth travel enthusiasts, primarily offering the following services:
- World Map and Globe: Visually explore destinations around the world and view POI (point-of-interest) location information;
- Smart Itinerary Planning: Based on a dual-axis map-and-timeline editor, help you create, edit, and manage your travel plans;
- Travel Content Community: Publish original travel content such as illustrated routes, travel diaries, and videos;
- Travel Social Circle: Follow like-minded travelers and receive the latest updates from the people you follow;
- Travel Passport: Record the footprints of your destinations and build a personal travel archive.
1.2 Service Updates
We reserve the right to modify, add, or discontinue certain service features at any time, and will notify you through means such as in-App notifications.
Chapter 2 Account Registration and Management
2.1 Eligibility for Registration
The use of the App is subject to the following conditions:
- You have reached the age of 14;
- Minors aged 14 or above but under 18 must use the App with the knowledge and consent of their guardian;
- Children under the age of 14 must be registered by their guardian on their behalf, with the express consent of the guardian; for details, see the Rules for the Protection of Children's Personal Information;
- You have full or corresponding capacity for civil conduct and are able to independently bear the legal liabilities under this Agreement (or have your guardian bear them on your behalf);
- You have not been permanently banned by this platform.
2.2 Account Registration Rules
(1) Real-Name Requirement: In accordance with the 《移动互联网应用程序信息服务管理规定》 (Provisions on the Administration of Information Services of Mobile Internet Applications), you must register your account using a genuine mobile phone number. We will verify your mobile phone number.
(2) Account Information: The information you provide upon registration must be true and accurate, and you undertake to update it promptly when the information changes.
(3) Uniqueness of Account: Each mobile phone number may register only one account. If your account is banned due to repeated registration or improper operation on your part, you shall bear the resulting losses.
(4) Username Standards:
- Usernames must be between 2 and 20 characters;
- The use of names of official institutions or well-known persons that are likely to cause confusion is prohibited;
- Abusive, discriminatory, or pornographic content is prohibited;
- Once set, a username may not be arbitrarily changed within 90 days.
2.3 Account Security
(1) You are responsible for the security of your account: You must properly safeguard your account and password, and may not lend your account to others or authorize others to operate it on your behalf.
(2) Account Theft: If you discover that your account has been compromised, please change your password immediately and contact us at legal@faroam.com. Before we receive such notice, you shall bear the consequences arising from the use of your account by others.
(3) Prohibited Conduct: Registering accounts by fraudulent means, registering accounts in bulk, or purchasing or selling accounts is strictly prohibited.
2.4 Account Deregistration
You may apply to deregister your account on your own initiative via "Settings" → "Account and Privacy" → "Deregister Account" in the App. After deregistration:
- The public content you have published will be automatically deleted within 30 days (except for content that has been lawfully reposted by others);
- Your social relationships (following/followers) will be cleared;
- Once an account is deregistered, it cannot be restored; please proceed with caution.
Chapter 3 User Conduct Standards
3.1 Basic Principles
When using the App, you must comply with the laws and regulations of the People's Republic of China, observe social morality, fulfill your network security obligations, and must not use the App to engage in any illegal or non-compliant activities.
3.2 Prohibited Conduct
(1) Illegal Content: It is strictly prohibited to publish or disseminate the following content:
- Content opposing the fundamental principles established by the Constitution;
- Content endangering national security or divulging state secrets;
- Content subverting state power or overthrowing the socialist system;
- Content promoting terrorism or extremism;
- Content inciting ethnic hatred or ethnic discrimination;
- Content spreading rumors and disrupting social order;
- Content disseminating obscenity or pornography;
- Content insulting or defaming others;
- Other content that violates laws and regulations.
(2) Platform Security: It is strictly prohibited to engage in the following conduct:
- Attacking or intruding into the platform's systems in any form;
- Using crawlers, bots, or other abnormal means to collect platform data in bulk;
- Spreading computer viruses, Trojan horses, or other malicious programs;
- Circumventing or undermining the platform's security measures;
- Interfering with the normal use of the platform by other users.
(3) False Information: It is strictly prohibited to publish false itinerary information or false reviews, or to mislead other users by deceptive means.
(4) Infringement: It is strictly prohibited to use content in which others hold intellectual property rights without authorization; it is strictly prohibited to infringe upon others' rights to privacy, portrait, or reputation.
(5) Commercial Abuse: It is strictly prohibited to use the platform to publish irrelevant commercial advertisements, conduct pyramid-selling activities, or disrupt platform order through means such as account trading or traffic inflation.
3.3 Interaction Standards
- When communicating with other users, please maintain a friendly and respectful attitude;
- You must not harass, maliciously attack, or cyberbully other users;
- You must not impersonate others or use a false identity to participate in community interactions.
Chapter 4 User Content and Intellectual Property
4.1 Ownership of User Content
You retain full intellectual property rights to the original content (routes, logs, images, videos, etc., hereinafter "User Content") that you publish on the App.
4.2 Grant of License
So that your content can be properly displayed and disseminated within the platform, you grant us a non-exclusive, worldwide, royalty-free, transferable, and sublicensable license, permitting us to:
- Display, disseminate, and promote your public content on this platform and affiliated channels;
- Perform technical format conversion of the content (such as compression and format conversion) to adapt it to different devices;
- Conduct compliance review and processing of the content in accordance with regulatory requirements.
The foregoing authorization terminates after you deregister your account and delete the relevant content, except in circumstances where retention is required by law.
4.3 Platform Intellectual Property
All intellectual property rights in the App and all of its content (including but not limited to software code, interface design, icons, copy, databases, and algorithms) belong to 慢漫科技(广州)有限公司 (Faroam Co., Ltd.) and are protected by the intellectual property laws of the People's Republic of China.
Without our written permission, you may not copy, modify, translate, disseminate, decompile, or reverse-engineer the App.
4.4 Infringement Complaints
If you believe that any content on this platform infringes your lawful rights and interests, please send your complaint materials (including proof of rights, a description of the infringing content, and contact information) to legal@faroam.com, and we will review and handle the matter within 5 business days.
Chapter 5 Platform Rights and Obligations
5.1 Content Management Right
We have the right, in accordance with this Agreement, the Community Guidelines, and applicable laws and regulations, to review User Content and to take measures such as deletion, blocking, and removal against non-compliant content without prior notice.
5.2 Account Disposition Right
For users who violate this Agreement, we have the right to take the following measures depending on the severity of the circumstances:
- Issuing a warning;
- Restricting specific features (such as posting or commenting);
- Temporarily banning the account (ranging from 1 to 30 days);
- Permanently banning the account.
In serious cases (such as illegal content), we reserve the right to report the matter to the competent authorities.
5.3 Service Assurance Obligation
We will make reasonable efforts to ensure the stable and continuous operation of the service and to promptly repair any failures. For service interruptions caused by factors such as force majeure, network attacks, or carrier failures, we will restore service and issue an announcement as soon as possible, but shall not be liable for compensation.
Chapter 6 Disclaimers
6.1 User Content Disclaimer
This platform provides users with tools for publishing content, and the User Content on the platform is the sole responsibility of the users. We do not bear joint and several liability for the authenticity, accuracy, or legality of User Content, but we will actively cooperate with the competent authorities in handling non-compliant content in accordance with the law.
6.2 External Links Disclaimer
The App may open third-party websites or services through the url_launcher feature; such external content is not governed by this policy, and we bear no liability in connection therewith.
6.3 Travel Safety Disclaimer
The travel content, itinerary suggestions, POI information, and the like provided by this platform are for reference only and do not constitute any safety guarantee. Users should assess travel risks on their own, comply with the local laws and regulations of the destination, and pay attention to their personal and property safety. Risks arising from travel shall be borne by the users themselves.
6.4 Force Majeure Disclaimer
For service interruptions or data loss caused by force majeure events such as earthquakes, floods, war, policy changes, or network infrastructure failures, we shall not be liable for compensation.
Chapter 7 Amendment and Termination of the Agreement
7.1 Amendment of the Agreement
We reserve the right to amend this Agreement at any time. After amendment, we will prompt you to review the updated content through an in-App pop-up. If you continue to use the App, you are deemed to have accepted the amended Agreement. Material amendments will require you to re-check your consent.
7.2 Termination of the Agreement
Under the following circumstances, this Agreement terminates automatically or upon notice:
- You voluntarily deregister your account;
- We permanently ban your account due to your material breach;
- The App ceases operation.
After the termination of the Agreement, the provisions of this Agreement concerning intellectual property, disclaimers, and dispute resolution shall remain in effect.
Chapter 8 Dispute Resolution and Governing Law
8.1 Governing Law
The conclusion, validity, interpretation, and performance of this Agreement, as well as the resolution of disputes, shall be governed by the laws of the People's Republic of China (excluding the laws of the Hong Kong, Macao, and Taiwan regions).
8.2 Amicable Negotiation
In the event of a dispute, the parties shall first seek to resolve it through amicable negotiation.
8.3 Jurisdiction
If negotiation fails, either party may bring a lawsuit before the People's Court of Tianhe District, Guangzhou, or bring a lawsuit before a people's court with jurisdiction in accordance with the law.
